Major Ordinance Violation Defense-Zoning Appeals

Our Experience

All property owners and business are subject to a maze of ordinances in the municipalities in which they live, own property, pay rent, or do business. These ordinances are often complex and contradictory.  Municipal town and city and county councils usually impose exorbitant penalties for ordinance violations. Frequently, land owners and businesses are subject to hundreds of dollars of fines for each day of a continuing violation, although fines are not usually imposed by administrative law judges and court judges for each such day. Alleged violators are summoned to administrative law court or circuit Court, depending on the nature of the alleged violations.

Steven H. Jesser provides major ordinance and zoning appeals representation. In the lives of residents and businesses, imposition of major ordinance violation fines and denial of requested zoning variances have a profound effect on their quality of life and their ability to remain and grow in their neighborhoods.

One of the most rewarding components of the Practice is to be able to help citizens and businesses at the street level, in defense of their residences and in support of businesses which want to move or grow in a neighborhood which accepts and welcomes diversity of citizens and businesses.  To this end, the firm focuses on:

  • Disputes with municipalities, including major ordinance violation complaints and zoning appeals

  • Municipal applications and permits

  • Representation before Administrative Law Judges in administrative proceedings

  • Representation in circuit to contest denial of zoning appeals, by filing and prosecuting complaints for administrative review
